Terms & Conditions
These terms govern the supply of installation, testing, and certification services by NET-COM SW LTD. Please read them carefully before engaging our services — they set out what you can expect from us, and what we ask of you in return.
Definitions
In these Terms & Conditions, the following definitions apply unless the context requires otherwise:
- "Company," "we," "us," "our" means NET-COM SW LTD, a company registered in England & Wales.
- "Client," "you," "your" means the individual, business, school, or other organisation that engages our services.
- "Services" means network cabling, fibre optic installation, CCTV, WiFi, UniFi networks, test & certification, 4G/5G aerials, TV mounting, and any other connectivity service we agree to provide.
- "Site" means the property or premises at which the Services are carried out.
- "Quotation" means the written estimate of costs provided to the Client following a survey or enquiry.
- "Certification Pack" means the test results, as-built diagrams, and compliance documentation issued on completion of cabling works.
Scope of Services
We provide professional installation, testing, and certification services across network cabling, fibre optic, CCTV, WiFi, UniFi networking, 4G/5G aerials, Test & Certification, and TV mounting, as described on our website and in any Quotation issued to you.
The precise scope of work for any project is defined in the Quotation accepted by the Client. Any work outside that scope — including additional cabling, hardware, or remedial work arising from pre-existing site conditions — will be treated as a variation and quoted separately before proceeding.
Please note: verbal estimates given prior to a formal site survey are indicative only. A binding Quotation is only issued following a survey, where required, or written confirmation for remote-quoted jobs such as TV mounting.
Quotes & Site Surveys
We offer free, no-obligation site surveys for most installation projects. Following a survey, we will issue a written, itemised Quotation valid for 30 days from the date of issue unless stated otherwise.
- Quotations are based on the site conditions observed at the time of survey. Concealed defects, inaccessible cable routes, or asbestos-containing materials discovered after work begins may result in a revised Quotation.
- Where a Quotation is accepted, work will only commence once a deposit (where applicable) has been received and a mutually agreed start date confirmed in writing.
- For simple jobs (e.g. TV mounting, single UniFi access point installation) a remote quote may be provided without a physical survey, based on information and photographs supplied by the Client.
Pricing & Payment
All prices quoted are in GBP (£) and, unless stated otherwise, exclude VAT, which will be added at the prevailing rate where applicable.
| Project Value | Standard Payment Terms |
|---|---|
| Under £1,000 | Full payment on completion |
| £1,000 – £5,000 | 50% deposit, balance on completion |
| Over £5,000 | Staged payments as agreed in the Quotation |
Invoices are due within 14 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, where applicable to business clients.
Non-payment: we reserve the right to suspend ongoing works, withhold Certification Packs, or pursue recovery action for accounts overdue by more than 30 days.
Site Access & Client Responsibilities
To allow us to carry out the Services safely and efficiently, the Client agrees to:
- Provide safe, timely access to the Site, including any keys, codes, or escort required.
- Disclose known hazards, including asbestos registers, structural concerns, or restricted areas, prior to commencement.
- Ensure adequate power and lighting are available unless otherwise agreed.
- Where relevant, provide accurate network/IT requirements and any existing system documentation.
- Obtain any necessary permissions (e.g. landlord consent, listed building consent) before work begins.
Delays caused by restricted access, missing information, or third parties engaged by the Client may result in revised timescales and, where applicable, additional charges for abortive site visits.
Timescales & Delays
Estimated start dates and project durations are provided in good faith at quotation stage. While we make every effort to meet agreed timescales, dates are not guaranteed and may be affected by factors including weather, site readiness, third-party trades, or supply chain delays on specific hardware.
We will notify the Client as soon as reasonably possible of any anticipated delay and agree a revised programme where required. We accept no liability for indirect losses arising from delays beyond our reasonable control (see Clause 15, Force Majeure).
Materials & Equipment
We specify and supply quality-assured cable, hardware, and equipment from trusted manufacturers as standard. Where a Client requests the use of their own supplied materials or equipment, we accept no responsibility for performance, compatibility, or warranty issues arising from that equipment.
Title & Risk
Title to materials and hardware passes to the Client only on full payment of the relevant invoice. Risk in installed materials passes to the Client on completion of installation at the Site.
Testing & Certification
Where cabling installation forms part of the Services, all links will be tested using a Fluke DSX-series cable analyser (or equivalent) to TIA-568 and/or ISO/IEC 11801 standards as applicable, and a Certification Pack issued at handover.
- Certification confirms the cabling meets the relevant standard at the point of testing. It does not extend to third-party active equipment, software configuration, or future site alterations.
- Standalone testing of third-party (non-NET-COM SW installed) cabling may identify faults outside our control; we are not responsible for remediation of such faults unless separately engaged to do so.
- Certification Packs will be withheld until full payment has been received for the relevant works.
Warranty
We warrant that installation workmanship will be free from defects for a period of 12 months from the date of completion, unless a longer period is stated in your Quotation. This warranty covers defects in our installation work only and does not cover:
- Manufacturer defects in hardware, which are covered separately by the manufacturer's own warranty.
- Damage caused by misuse, unauthorised modification, or third-party works carried out after handover.
- Faults arising from power surges, lightning strikes, or other events outside our control.
- Normal wear and tear, or consumable components (e.g. batteries).
To make a warranty claim, please contact us with details of the issue and your original invoice or job reference. We will assess and, where the claim is valid, remedy the defect at no additional cost within a reasonable timeframe.
Cancellation & Refunds
The Client may cancel a booked installation by providing at least 48 hours' written notice prior to the scheduled start date without charge, except for any non-refundable costs already committed (e.g. bespoke ordered hardware).
Cancellations made with less than 48 hours' notice, or on the day of a scheduled visit, may incur a call-out charge to cover engineer time and travel already committed.
Consumer clients booking services for personal (non-business) use may have additional cancellation rights under the Consumer Contracts Regulations 2013, including a statutory 14-day cooling-off period for services arranged at a distance or off-premises, subject to the usual exceptions where work has already begun at the Client's request.
Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded or limited under applicable law.
Subject to the above, our total liability arising from or in connection with the Services — whether in contract, tort, or otherwise — shall not exceed the total fees paid by the Client for the specific Services giving rise to the claim.
We shall not be liable for any indirect, special, or consequential losses, including but not limited to loss of profit, loss of business, or loss of data, arising from or in connection with the Services.
Insurance
NET-COM SW LTD holds public liability insurance for the duration of all works carried out at Client sites. Certificate details are available on request. Where Client-specific insurance requirements apply (e.g. for school or commercial sites), please advise us in advance so that compliance can be confirmed prior to commencement.
Intellectual Property
Any network designs, schematics, cable schedules, or documentation produced by us as part of the Services remain our intellectual property until full payment has been received, at which point a licence to use such documentation for the Client's own internal purposes is granted. We retain the right to use anonymised project details and photographs for our own marketing and portfolio purposes, unless the Client requests otherwise in writing — particularly relevant for education and sensitive commercial sites.
Data Protection
Any personal data collected in connection with the Services is processed in accordance with our Privacy Policy and applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to extreme weather, fire, flood, pandemic, strikes, supply chain disruption, or government restrictions. We will notify the Client promptly and take reasonable steps to minimise the impact of any such event.
Disputes & Governing Law
We aim to resolve any concerns directly and informally wherever possible — please contact us in the first instance using the details below. These Terms & Conditions, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the laws of England & Wales. The courts of England & Wales shall have exclusive jurisdiction over any such dispute, save where mandatory consumer protection law provides otherwise.
Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our services, legal requirements, or business practices. The version in force at the time a Quotation is accepted will apply to that engagement. The latest version will always be available on this page, with the effective date shown at the top.
